1. Agreement to Terms
By accessing or using the BLACKFILE platform at blackfile.co (the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by:

If you do not agree to these Terms, you must not access or use the Service.
2. Description of the Service
BLACKFILE is a self-discovery platform that generates personality dossiers based on user-submitted responses to open-ended questions. The Service uses an artificial intelligence system (a large language model provided by Anthropic) to analyze free-text responses and produce a detailed personality report ("Dossier").
Important disclaimer: BLACKFILE is not therapy, counseling, or a diagnostic tool. It is not a substitute for professional psychological or medical advice. The Dossier is provided for entertainment and self-discovery purposes only. No clinical or diagnostic claims are made. Your Dossier is generated by an artificial intelligence system and should be understood as such.
3. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
4. Account and Assessment
No account creation is required to use the Service. You complete an assessment by answering a series of open-ended questions and submitting payment. Each purchase grants access to one (1) Dossier generated from your responses.
5. Pricing and Payment
The Service is offered as a one-time purchase at a price of $29 USD per Dossier. Payment is processed securely through Stripe. All prices are displayed in US dollars. Applicable taxes may apply depending on your jurisdiction and will be calculated at checkout.
We reserve the right to modify pricing at any time. Any price change will not affect purchases already completed.
6. Right of Withdrawal and Refund Policy
6.1 EU/EEA Consumers — Right of Withdrawal
In accordance with EU consumer protection law (Directive 2011/83/EU) and the French Consumer Code (Code de la consommation, Articles L.221-18 et seq.), you have a 14-day right of withdrawal from the date of purchase, without giving any reason.
To exercise this right, you must inform us of your decision by an unequivocal statement (e.g., email to tomviseur7@gmail.com) or by using the model withdrawal form provided below.
6.2 Waiver of Withdrawal for Digital Content
If you wish to access your Dossier immediately upon payment, you will be asked during checkout to: (a) expressly consent to the immediate delivery of the digital content; and (b) expressly acknowledge that you thereby lose your right of withdrawal.
If you have given such consent and acknowledgment, the right of withdrawal is waived upon delivery of the Dossier, in accordance with Article L.221-28 of the French Consumer Code.
6.3 Refund Processing
Refund requests within the 14-day period (where the right of withdrawal has not been waived) will be honored in full. Refunds are processed via the original payment method (Stripe) and may take 5–10 business days to appear on your statement.

7. Legal Guarantees
7.1 Guarantee of Conformity (EU/France)
In accordance with Articles L.224-25-12 et seq. of the French Consumer Code, digital content must conform to the contract. If the Dossier does not conform to what was agreed (e.g., it was not delivered, is fundamentally incomplete, or does not correspond to the service described), you may request that it be brought into conformity, obtain a price reduction, or terminate the contract, in accordance with the conditions set out by law.
You benefit from a period of 2 years from the date of delivery to invoke the legal guarantee of conformity for digital content.
7.2 Guarantee Against Hidden Defects
In accordance with Articles 1641 et seq. of the French Civil Code, you may also invoke the guarantee against hidden defects if the defect existed at the time of delivery and renders the product unfit for its intended use, or so diminishes that use that you would not have purchased it, or would have paid a lower price, had you known of the defect.
8. Intellectual Property
All content, branding, design, algorithms, and underlying technology of the Service are the exclusive property of Tom Viseur EI, trading as BLACKFILE, and are protected by applicable intellectual property laws.
Upon purchase, you receive a personal, non-transferable, non-exclusive license to access and use your Dossier for personal purposes. You may not reproduce, distribute, sell, sublicense, or publicly display the underlying system, methodology, or archetype framework without our prior written consent.
You retain ownership of your text responses. By submitting responses, you grant us a limited license to process them for the sole purpose of generating your Dossier, and for anonymized, aggregated improvement of our algorithms.
9. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law;
- Attempt to reverse-engineer, decompile, or extract the underlying algorithms, prompts, or methodology;
- Submit false, misleading, or harmful content in your responses;
- Use automated tools, bots, or scripts to access or interact with the Service;
- Resell, redistribute, or commercially exploit Dossiers or any part of the Service.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or accuracy of AI-generated content.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to: emotional distress, reliance on Dossier content, decisions made based on Dossier results, or loss of data.
Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid for the relevant Dossier ($29 USD).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or death/personal injury caused by negligence. These limitations do not affect your statutory rights as a consumer under French or EU law, including the legal guarantees described in Section 7.
11. Third-Party Services
The Service uses third-party providers including Stripe (payment processing), Supabase (data infrastructure), Anthropic (AI processing), and Netlify (hosting). Your use of the Service is also subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of third-party providers beyond our contractual obligations.
12. Modifications to Terms
We may update these Terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after changes constitutes acceptance. For material changes, we will make reasonable efforts to notify users (e.g., via the website or email if provided). Material changes will not apply retroactively to purchases already completed.
13. Governing Law and Dispute Resolution
13.1 EU/EEA Consumers
These Terms are governed by the laws of France. You may bring claims in the courts of your country of residence in accordance with applicable EU consumer protection regulations (Regulation (EC) No 593/2008, Article 6).

13.2 Mediation

13.3 All Other Users
These Terms are governed by the laws of France. Any disputes shall be submitted to the exclusive jurisdiction of the competent courts of Paris, France.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
